On the approval of the Rules for Transfer and Restoration of Students by types of educational organizations

In accordance with subparagraph 16 of Article 5 of the Law of the Republic of Kazakhstan dated July 27, 2007 “On Education”, I ORDER:

 

1.      To approve the attached Rules for transfer and restoration of students by types of educational organizations.

2.      To recognize the Order of the Minister of Education and Science of the Republic of Kazakhstan dated 13 January 2005 № 13 “On the Approval of the Rules for Transfer and Restoration of Students in organizations providing primary professional, secondary and higher professional education” (registered in the Register of State Registration of Regulatory Legal Acts of the Republic of Kazakhstan on February 7, 2005 № 3426, published on October 18, 2005 in the “Юридическая газета” (“Legal newspaper”) № 192 (926) as invalid.

3.      To provide the Department of Higher and Post-Graduate Education (S. Omirbaev) with the state registration of this order in the Ministry of Justice of the Republic of Kazakhstan in accordance with the procedure established by law.

4.      This order is put into effect upon expiration of ten calendar days after its first official publication.

5.      To entrust the control over the execution of this order to the Vice-Minister K.N. Shamshidinov.

The Rules for transfer and restoration of students by types of educational organizations

1. General statements

 

1. The rules for transfer and restoration of students by types of educational organizations (hereinafter – Rules) have been developed in accordance with subparagraph 16 of Article 5 of the Law of the Republic of Kazakhstan “On Education”.

2. The rules determine the procedure for the transfer and restoration of students in educational organizations, regardless of the form of ownership and departmental affiliation.

3. The students of educational organizations are:

1) Students of educational organizations, mastering professional training programs of technical and professional, post-secondary education;

2) Students – who study in educational organizations, mastering professional higher education curricula;
3) Cadets – servicemen: soldiers (sailors), sergeants (foremen) studying in educational units (centers), secondary or higher military educational institutions;

4) Interns – students of medical higher educational institutions within the framework of basic medical education;

5) Adjuncts – students who master professional training programs of postgraduate education in military educational institutions;

6) Residency listeners (resident-intern) – a specialist who masters educational programs of residency;
7) Master’s student – studying educational and scientific organizations mastering professional training programs of postgraduate education in the magistracy;

8) Doctoral students – studying in the educational and scientific organizations, mastering professional educational programs of postgraduate education in doctoral studies.

4. Transfer of students is carried out from year to year, from one educational organization to another, from one form of study to another, from one specialty to another.
5. Applications of students of full-time and evening forms of studying on transfer and restoration are considered by the head of an educational organization during the summer and winter holidays within five working days.
Applications of students of extramural form of study on transfer and restoration are considered by the head of an educational organization before the next examination period.
6. In the case of restoration and transfer of students, the difference in the disciplines of the working curricula studied by them during the previous academic periods is determined.

7. The difference in the disciplines of working curricula is determined by the head of the department on the basis of the list of studied disciplines, their programs and volumes reflected in the copy of the educational card (transcript), or in a certificate issued to citizens who did not complete the education (hereinafter Certificate).

8. When a student is restored or transferred from a foreign educational organization, a document on the completed training programs (academic certificate, transcript) and a document on the completion of the previous level of education, which must pass through the established procedure for recognition or notification in the Republic of Kazakhstan, are submitted.
9. In order to eliminate the difference in the disciplines of the working curriculum, the student attends all types of lessons during the academic period, passes all types of current and midterm control provided by the curriculum, receives admission to the final control.
10. The difference in the disciplines of the working curriculum that has not been liquidated within the prescribed period is subsequently considered as academic debt.

 

2. Transfer and restoration of students in educational institutions of technical and professional, post-secondary education

 

11. Transfer from one specialty to another or from one form of study to another in one educational institution is carried out by the order of the head of the educational organization.
12. If the student has concluded an individual contract with the organization (institution, enterprise), then his transfer to another educational institution or from one specialty to another must be preceded by a change or termination of the indicated contract.
13. Transfer of a student to the first year is allowed after completion of the first semester in a related specialty.

14. The student who desires to transfer to another educational institution applies for transfer to the head of the educational organization where he is studying and having received a written sealed consent for the transfer, addresses to the head of the educational organization that is of interest to him.

An extract from the student’s record book, certified by the signature of the head of the educational organization, from where he is transferred, must be attached to the application for transfer to the name of the head of admitting educational organization.

15. In the case of the decision on transfer, the head of the educational organization admitting the student issues an order on admitting him to lessons, handing over the difference in the curriculum sends a written request to the educational organization where he studied previously to send his personal file.

16. The order on admission to the number of students of the educational institution is issued after the receipt of the personal file of the student from the educational institution where he studied previously.
17. Citizens who studied earlier in educational institutions of technical and professional, post-secondary education can be restored to a former or other educational institution.

An obligatory term for the restoration is the student’s completion of one semester, and the issue of restoration is considered only on the basis of a personal application.

Restoration of students to the first year is allowed after the completion of the first semester for a corresponding or related specialty.

18. Students studying on paid basis, who were expelled during a semester for non-payment of tuition, in the event of debt-repayment, are entitled to be restored within four weeks from the date of expulsion, while the educational organization restores the student upon presenting the document on debt-repayment within three working days.

19. Restoration of students studying earlier in other educational institutions is allowed: if there are appropriate training groups for courses (years) and specialties; in the case of difference in the educational disciplines indicated in the Certificate issued to citizens who have not completed the training (or in the student’s record book), with a list of the academic disciplines of the working curriculum that admitting educational institution - no more than four academic disciplines.
20. The difference in the disciplines and training hours of the working curriculum is established by the deputy head of the educational organization for academic works in educational organizations that implement technical and professional, post-secondary education. The procedure and deadlines for eliminating the difference in the disciplines of the curriculum are approved by the order of the head of the educational organization.

21. When restoring students to another educational organization, the head of the educational organization, where the student studied previously, sends a personal file of the student retaining a copy of the certificate, a record book and an inventory of the documents being forwarded on the basis of a written request of the admitting party.

22. The restoration of students from private educational institutions to state organizations is carried out for an appropriate or related specialty for studying on a paid basis.
23. In order to be restored, the student submits an application to the head of the educational organization, where he wishes to continue his education, while he attaches the Certificate to the application for restoration.

24. The educational organization should consider the application for restoration on the basis of the submitted Certificate within two weeks from the date of its submission, determining the year and the difference in the disciplines.

 

3. Transfer and restoration of students in higher educational institutions

25. An obligatory condition for the transfer or restoration is the fulfillment of all the requirements of the working curriculum of the first academic period and passing of a midterm attestation.

26. Transfer and restoration are carried out to the same year, if the difference in the curriculum for the undergraduate studies is not more than five academic disciplines of the obligatory component, and for the magistracy and doctoral studies is not more than three.
27. When determining the difference in disciplines, the difference in the forms of final control is not taken into account.
The credit is equated to the letter system of assessing the student’s academic achievements in the range from the minimum D (1.0, 50-54%) to the maximum A (4.0, 95-100%).

28. The transfer of students from year to year is carried out at the end of the summer examination session (midterm attestation), taking into account the results of the summer semester and the scored transferable point.

29. The transfer of the student from year to year is formalized by the order of the head of the higher educational institution (hereinafter – university).

30. The student studying under educational grant who scored an established transferable point and who has been transferred to the next year with academic debt, does not lose an educational grant, and eliminates academic debt on a fee basis.

31. An educational grantee, who has been left for a repeated year of study, is deprived of this grant and studies further on a paid basis.

32. Transfer of master’s and doctoral students from one educational and scientific organization to another is carried out only for studying on a fee basis.

33. The procedure for transferring a student from one university (scientific organization) to another is carried out in the following order:

1) the student, who desires to transfer to another institution, submits an application for transfer to the head of the institution where he is studying, and, having received a sealed written consent for the transfer, addresses to the head of the university that is of interest to him;
2) the application for transfer to the head of admitting university must be enclosed with the copies of: educational card signed by the dean of the faculty (director of the institute), a transcript signed by the office registrar, certified by the signature of the head of the educational department (educational-methodical department or administration) and by a seal; a certificate of passing a unified national testing or comprehensive testing; a certificate of the holder of the educational grant (if he/she is a holder of educational grant); a copy of the application addressed to the head of the university where he studied (with the signature of the head and the seal);
3) the dean of the faculty (director of the institute), on the basis of the submitted documents, determines the difference in the disciplines of the mandatory component of the working curriculum and the year of study;

4) in accordance with the visas of the dean of the faculty (director of the institute), the head of the educational department (the teaching and methodical department or administration), the deputy head of the university for academic work, the head of the university issues an order to transfer the student.

34. The head of the institution to which the student is transferred, within three working days from the date of issuing the order, sends a written request to the university, where the student studied previously, on sending his/her personal file.
35. The head of the university, where the student studied previously, after receiving such a request, issues an order for expulsion with the wording “expelled in connection with the transfer to (name of the university)” and within three working days from the date of issuing the expulsion order, sends the student’s personal file to the address of the admitting university.
In the university, where the student studied, he/she leaves copies of the educational card and transcript, record book, student’s card and inventory of the documents being sent.

36. When transferring a student on the basis of educational grant from one university to another, the head of the admitting university submits to the authorized educational body and the administrator of the corresponding budget program a copy of the order to enroll the student with a copy of the certificate of the educational grant issued in his/her name, to adjust university’s fund.

37. In the case if a student is transferred from one university to another under the educational grant to a year lower, he/she is deprived of the educational grant.
38. It is not allowed to transfer the students enrolled in target places on the state educational order approved for separate universities, as well as for pedagogical specialties within the allocated quota, to another university with the preservation of an educational grant.

39. The transfer of students for studying on a fee basis from one university to another is accompanied by the conclusion of a contract between the student and the admitting university.

40. The student who has been expelled from the university may be restored to the number of students to any form of studying, to any specialty and to any university, regardless of the terms of the expulsion.

41. The student studying on a fee basis, being expelled due to the non-payment of tuition fee, in case of repayment of this debt, may be restored within four weeks from the date of expulsion.

42. The restoration to the number of students and the elimination of the difference in disciplines of the working curriculum is carried out only on a paid basis.

43. The restoration procedure:

1) The student submits an application for restoration to the head of the university, in which he/she wishes to continue his education. The application for restoration is accompanied by the Certificate (original);

2) the dean of the faculty (director of the institute), on the basis of the Certificate provided, determines the difference in the disciplines of the working curriculum and the year of studying;
3) in accordance with the visas of the dean of the faculty (director of the institute), the head of the educational department (educational-methodical department or administration) of the deputy head of the university, the head of the university issues an order to restore the student.
44. A request for restoration shall be submitted no later than five working days before the start of the regular academic period.

45. If the student is restored in another educational organization, the head of the university where the student studied previously sends a personal file of the student on the basis of a written request from the admitting party, leaving a copy of the Certificate, educational card, record book, student’s card and inventory of the documents being forwarded.

46. ​​ The head of the university must take a decision on restoration no later than three working days before the beginning of the training sessions.

47. The procedure and deadlines for eliminating the difference in the disciplines of the working curriculum shall be formalized by the order of the faculty’s dean (director of the institute).

48. The transfer of a student from one specialty to another, from one form of study to another, is carried out only for the study on a fee basis.

49. The transfer of a student from one specialty and form of study to another within one university is accompanied by the introduction of appropriate changes in the contract and is formalized by the order of the head of the university.

50. The educational grantee who has a conclusion of the medical consulting commission on the prohibition of studying in this specialty as a result of an acquired illness during the training period, is transferred from one specialty to another for an available vacancy under educational grant.
